Nursing Home Negligence

Nursing Home Claims include actions for money damages against Nursing Home licensees and owners for abuse or neglect by Nursing Home employees and agents.

We believe that when families entrust the care of their loved ones to a Nursing Home, they should be able to expect competent, compassionate, professional care in a safe and healthy environment

Unfortunately, according to some estimates, between one and two million American nursing home residents, age 65 or older, have been abused or neglected in one way or another.  This statistic flies in the face of the fact that nursing home residents are entitled to patient rights and protections under the law.

The Illinois Nursing Home Care Act provides residents with important rights regarding their care and treatment, including the right to recover money damages suffered as a result of abuse or neglect. Under the Act, the owner and licensee are strictly liable for any intentional or negligent act or omission of their employees or agents which results in personal injury even if the act or omission was beyond their employment scope.

Common types of Nursing Home Claims that result from neglect and mistreatment include:

  • Falls and resulting fractures
  • Patient wandering and leaving the facility
  • Malnutrition /Dehydration
  • Bed Sores/Infection/Sepsis
  • Medication errors
  • Physical Abuse
  • Sexual Abuse
